Heard learned counsel for the petitioner and Sri Narendra Kumar Giri, on behalf of the respondent-Bank.
The case for petitioner is that he is a farmer and applied for loan before respondent No. 3, Uttar Pradesh Sahkari Gram Vikash Bank Ltd, Branch Ujahani, District Budaun and ultimately he was given loan on 20.3.2010 but after receiving loan amount of Rs.3,00,000/- he could not pay the installment.
It is further stated that in the month of April 2018 due to non- payment of loan, recovery citation of Rs. 3,920,40/- was issued. The respondent No.2 has issued a One Time Settlement Scheme on 5.4.2018 in respect of the loan sanctioned by the Bank to the farmer.
Petitioner has, further, submitted that he is also entitled for the relief given in One Time Settlement Scheme on 5.4.2018 and for which he is submitted an application dated 16.4.2018 before respondent no.2, but till date same has not been decided.
Learned counsel for the petitioner submitted that his application for grant of relief given in One Time Settlement Scheme may be decided within time fixed by the Court.
Learned counsel for the petitioner has, further, submitted that he may be permitted to file a fresh application along with certified copy of the order. Prayer made by the learned counsel for the petitioner is accepted and is permitted to file a fresh application along with certified copy of the order within a week from today.
The writ petition is disposed of with the direction to decide the application of petitioner within two weeks from the date of production of certified copy of this order.
