JUDGMENT / ORDER

Court No. - 49
Case :- CRIMINAL REVISION No. - 1871 of 1993 Revisionist :- Rajendra @ Raja Nal Opposite Party :- Smt. Natthoo Devi Counsel for Revisionist :- S.N. Singh Counsel for Opposite Party :- A.G.A.,A.K. Shukla Hon'ble Harsh Kumar,J.
List revised. No one is present on behalf of the revisionist. Heard learned A.G.A. and perused the record.
Learned A.G.A. has pointed out that by the impugned order dated 16.8.1993, learned Magistrate has issued recovery warrant for recovery of arrears of maintenance of Rs. 31250/-. He submitted that since passing of the impugned order around 25 years have passed and during this period either the impugned amount would have been recovered or the parties would have come to terms.
The matter appears to have become infructuous.
Accordingly, the revision is dismissed as infructuous. However, if the revisionist finds that cause of action survives he may move an application for recall within the prescribed limitation period.
Interim order, if any, stands vacated.
