1. Heard Sri U.B. Singh, Advocate, for petitioner and learned Standing Counsel for respondents.
2. Petitioner was given a show-cause notice alleging that he has misbehaved with a person and implicated him in a fictitious prosecution. When petitioner did not submit any reply to show cause notice dated 23.03.2001, Superintendent of Police, Deoria by order dated 18.09.2001 imposed punishment of withholding of one increment. Thereagainst petitioner preferred appeal which has been rejected by order dated 31.12.2001 passed by Deputy Inspector General of Police, Gorakhpur Range, Gorakhpur and petitioner's revision has also been rejected by Revisional Authority as barred by limitation.
3. Counsel for petitioner submitted that without any regular departmental inquiry punishment has been imposed but could not dispute that punishment imposed is a minor punishment and show-cause notice was issued which is prescribed under Rules. Hence, I do not find any illegality in the procedure adopted by respondents.
4. No other point has been argued.
5. The writ petition lacks merits. Dismissed.
