Heard counsel for the petitioner and Standing Counsel for State-respondents.
By the order dated 22.11.2017, the Standing Counsel was directed to obtain instruction in the matter.
Written instruction has been supplied by the Standing Counsel, which is taken on record.
A perusal of the written instruction shows that the Screening Committee in its meeting dated 26.7.2017 has considered the candidature of the petitioner. The report has been submitted for consideration of Screening Committee by Superintendent of Police which shows that during service period there were 40 censure entries against the petitioner and he was also awarded punishments of fine also. During ten years of service, there were 25 censure entries and the order of imposing fine upon the petitioner. On its basis , the petitioner was not found suitable for retaining in the service.
The order of compulsory retirement, does not suffer from any illegality. So far as suitability is concerned, it is for the appointing authority to satisfy with the suitability of the employee for retaining in service. This Court cannot review the judgement of the appointing authority.
The writ petition has no merit and it is dismissed accordingly.
