Rajendra Kumar vs State Of U P And Others

High Court Of Judicature at Allahabad|11 October, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 41765 of 2004 Petitioner :- Rajendra Kumar Respondent :- State Of U.P. And Others Counsel for Petitioner :- Anoop Trivedi Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioner.
2. By means of the present writ petition, petitioner has sought the following reliefs:
“(a) issue an appropriate writ, order or direction quashing the order dt. 30.6.2004 passed by the respondent no. 3 (As contained in Annexure No. 9).
(b) issue an appropriate writ, order or direction declaring the Government order no. 28/5/80- Ka-4-1999 dated 15.11.1999 to be ultravires in so far as they relates to non preparation of waiting list in selection process of combined services.
(c) issue an appropriate writ, order or direction quashing the Government order no. 28/5/80- Ka-4-1999 dated 15.11.1999 in so far as they relates to non preparation of waiting list in selection process of combined services.
(d) issue an appropriate writ, order or direction commanding the respondents concerned to prepare and communicate the waiting list for the selection held for the post of junior clerk in District Supply Office, Lalitpur.
(e) issue an appropriate writ order or direction commanding the respondents concerned to appoint the petitioner on the post of Junior Clerk in the District Supply Officer, Lalitpur.”
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
