Heard learned counsel for the applicant.
The applicant had preferred a writ petition seeking consideration of his claim for promotion from Sub Inspector to Inspector in the Civil Police. As per the instructions placed before this Court, it transpires that the applicant had been awarded a censure entry and consequently he was not considered for five years for promotion. It was in this context that the writ petition was disposed of with an observation that in case the effect of the last censure entry has come to an end, the case of the applicant may be considered for promotion.
Learned counsel for the applicant has drawn the attention of the Court to an order dated 26 August 2013 in terms of which an order of suspension was brought to an end and the applicant reinstated. It is also his contention that the effect of the censure entry shall no longer operate as a fetter on his claim for promotion. It is however not disputed that the claim for promotion must be placed for consideration of the Chairman of the U.P. Police Recruitment and Promotion Board.
Consequently and in the interest of justice, this petition shall stand disposed of with the following directions.
It shall be open to the applicant to approach the Chairman of the Board by way of a detailed representation to be filed within a period of two weeks from today. In case the same is preferred before the Chairman, he shall ensure that the same is considered and disposed of in accordance with law with expedition and preferably within a period of one month therefrom.
The petition stands disposed of with the aforesaid directions.
