Heard Sri Prabhakar Awasthi, learned counsel for the petitioner and learned Standing Counsel for the respondents.
Pursuant to a notification for filling up vacancies of Associate N.C.C. Officers (ANO) issued on 31.08.2018, the petitioner submitted his application for appointment as ANO. The claim of the petitioner has been rejected by order dated 30.09.2018 on the premise that the petitioner was overage on the date of submission of his application form. The age limit for appointment as ANO was 42 years and it was prescribed in the notification itself. The relevant clauses are extracted here under:-
"5. Age Limit for candidates
(a) Candidates applying for SD/JD/SW/JW ANOs should not be "below 21 years of age and should not be above 42 years of age on "1st Nov 2018 (i.e. last date of receipt of application)".
(b) The upper age limit is relaxable for further three years i.e up to 45 years of age at the sole discretion of DG NCC. No further relaxation with be given/provided."
The date of birth of the petitioner is 05.04.1972. Admittedly on the date of notification the petitioner was above 45 years of age, which is above the minimum age of eligibility. He was not entitled even for the relaxation of age at the sole discretion of NCC Directorate.
There is no merit in the instant writ petition. The writ petition is dismissed.
