JUDGMENT / ORDER

Court No. - 36
Case :- CRIMINAL MISC. BAIL APPLICATION No. - 4762 of 2020 Applicant :- Rajesh Opposite Party :- State of U.P.
Counsel for Applicant :- Om Narayan Pandey Counsel for Opposite Party :- G.A.
Hon'ble Neeraj Tiwari,J.
This is second bail application.
Heard learned counsel for the applicant and Sri Manoj Gautam, learned AGA for the State-respondents.
The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 658 of 2018, under Section 376 and 506 I.P.C., Police Station -Tilhar, District -Shahjahanpur.
Learned counsel for the applicant could not point out any new ground except this fact that charges have been framed but trial has not been completed till date. He also submitted that applicant is languishing in jail since 29.11.2018.
Considering the facts and circumstances of the case, criminal history of the applicant, the gravity of the offence, the nature of accusations and severity of punishment in case of conviction, there does not appear any good ground to release the applicant on bail.
At this juncture, learned counsel for the applicant prayed that the trial is proceedings at snail's speed, hence the trial court be directed to conclude it within some time bound period.
However, the trial court is directed to make all possible efforts to conclude the trial on day to day basis, expeditiously, if possible, within a period of six months from the date of production of computer generated copy of this order.
With the aforesaid observations, the bail application is rejected. Order Date :- 22.9.2021 Sartaj
