Challenge is made to the judgment and order of the learned Chamber Judge, City Civil Court in Civil Suit No.2679 of 2003 vide Exh.17.
The petitioners submit that Execution Application No.26 of 2008 was preferred against the present petitioners and therefore, the petitioners preferred SCA No. 2125 of 2011 in which a detailed order was passed by this Court on 5.5.2011, wherein present petitioners have been directed to deposit cheques worth Rs.16,68,623/-.
It is submitted jointly that no amount has been paid towards the decreetal dues till the date and all the cheques which had been presented by the petitioners herein have been dishonoured. Not only there is non-compliance of the directions issued by this Court, but there also appears to be flagrant violation and abuse of process of court by not complying with the directions and thereafter, challenging the execution proceedings. Nothing could be pointed out which would warrant any interference in the order of the learned City Civil Judge. The petition being devoid of any merit, the same is dismissed.
