Heard Sri Saroj Kumar Yadav, learned counsel for the petitioner, Sri Pradeep Verma, learned counsel for the respondents no. 2 and 3 and the learned Standing Counsel for the respondent no.1.
The petitioner in the writ petition is seeking quashing of the order dated 25.9.2017 whereby his claim for minimum pay in the Nagar Palika Parishad has been rejected.
The petitioner is claiming minimum pay scale equal to that as admissible to regular pump operators in the light of the judgment of the Supreme Court in the case of State of Punjab vs Jagjit Singh, (2017) 1 SCC 148.
Sri Pradeep Verma, learned counsel for the respondent informs that the matter is under consideration. He has received instructions from the Executive Officer, Nagar Palika Parishad, Farukhabad dated 23.4.2018 stating that the matter is under consideration.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no.3-Executive Officer, Nagar Palika Parishad, District Farrukhabad to take a decision in the matter with regard to the claim of the petitioner for grant of minimum pay scale equal to that of regular pump operators in the department bearing in mind the judgement of the Supreme Court in the case of State of Punjab Vs Jagjit Singh (supra) within a period of three months from the date of receipt of a certified copy of this order in his office.
The impugned order dated 25.9.2017 shall be subject to any final order which may be passed by the respondent no.3.
Instructions passed on to the court are kept on record.
