The present application under Section 482 Cr.P.C. has been filed by the applicants with the prayer to quash the entire proceedings of complaint case no. 1154 of 2009 under Sections 420, 467, 468, 471, 120-B IPC, Police Station Civil Lines, District - Meerut pending in the Court of Addl. Chief Judicial Magistrate-V, Meerut as well as order dated 12.6.2019 passed by the court concerned. Further prayer has been made to stay the further proceedings of the aforesaid case.
Heard learned counsel for the applicants and the learned AGA appearing for the State.
Earlier, applicants have approached this Court invoking jurisdiction under section 482 Cr.P.C. by filing application u/s 482 No.-15508 of 2018 and prayer in respect of present applicants was refused by this Court vide order dated 4.5.2018. Present application has been moved with the prayer to quash the non-bailable warrant issued on 12.6.2019.
Since applicants did not surrender before the court concerned after passing the order dated 4.5.2018 in the aforesaid application u/s 482 Cr.P.C., order issuing non bailable warrant against the applicants cannot be termed to be illegal. Issuance of non-bailable warrant is within the jurisdiction of the court concerned.
Application is dismissed accordingly.
