This writ petition has been filed for a direction upon respondents to consider and grant promotion to the petitioner on the post of Clerk under 50% promotional quota within the time specified by this Court.
Petitioner is working in M.M.Inter College Khekhara, Baghpat. It is stated that a post of Assistant Clerk in the institution has fallen vacant and petitioner being the senior most person is liable to be considered for promotion. It is stated that a person much junior to petitioner has approached this Court by filing Writ Petition No.5905 of 2018, and a direction has been issued by this Court for consideration of his case for promotion. Submission is that petitioner being senior and eligible for promotion, his case is also liable to be considered.
Considering the nature of the order proposed to be passed today, notices need not be issued to respondent nos. 4 and 5, and the writ petition is being disposed of, at this stage itself.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.3, in respect of his grievance, noticed above, alongwith certified copy of this order. The competent authority shall deal with the grievance of petitioner relating to grant of promotion to him, in accordance with law, within a period of three months from the date of presentation of certified copy of this order. Any person, who has staked a claim or is liable to be considered for promotion, shall also be considered.
