1. Heard Sri Pankaj Kumar, learned counsel for the applicant and Sri Shesh Mani Misra, learned counsel for the opposite party.
2. Sri A.C. Tripathi, learned Standing Counsel, who had been appointed as arbitrator in the matter, informs that his consent had been obtained on the order sheet.
3. Perusal of the order sheet of the case reveals that on 04.09.2018, Sri A.C. Tripathi, had received a copy of the order and thus signified his consent to be appointed as the arbitrator.
4. Accordingly, Sri A.C. Tripathi, learned Standing Counsel of this Court was appointed as the arbitrator under the order dated 28.08.2018.
5. The arbitrator shall be entitled to fees, in accordance with the provisions of fourth schedule inserted by Act No.3 of 2016. The expenses shall be borne equally by the parties.
6. The application under Section 11 of the Act thus, stands allowed.
