Hon'ble Manoj Kumar Gupta,J.
By order dated 18.12.2017 in PIL No.60098 of 2017, this Court directed the Divisional Forest Officer to examine the grievance of the applicant in respect of illegal encroachment over certain forest land, within six months.
An affidavit has been filed by the opposite party stating that he has passed an order on 1.9.2018, according to which the land in question is recorded as pasture land and thus it belongs to Revenue department.
The opposite party has also returned a finding that he is not competent to deal with the land as it belongs to the Revenue department.
Having regard to the above stand taken by the opposite party, this Court is not inclined to proceed in contempt but leaves it open to the applicant to take such legal proceedings for removal of encroachment as may be advised.
The contempt application stands disposed of.
