Heard learned counsel for the petitioner and Shri Ram Babu Yadav for the Gaon Sabha as also learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) to issue a writ, order or direction in the nature of mandamus commanding the respondent no.2/ Sub Divisional Magistrate, Sadar, District Bhadohi (Sant Ravidas Nagar) to decide the Suit No.00425/2018 (Rajaram Singh Vs. Rajesh Bahadur Singh and others), filed U/s 116 of U.P. Revenue Code, 2006, expeditiously within a stipulated period as fixed by the Hon'ble Court"
The petitioner is aggrieved on account of pendency of his partition suit filed in the year 2018.
Perusal of the order sheet annexed along with the writ petition indicates that till date the issues has not been framed nor the evidence of the parties, led.
It is, further submitted that the notices have been served upon the defendants in the suit.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, Sub Divisional Magistrate, Sadar, District Bhadohi (Sant Ravidas Nagar) to endeavour to decide the partition suit of the petitioner, expeditiously, preferably within a period of eighteen months from the date a certified copy of this order is filed before him.
