Petitioner's mother Smt. Kumkum was employed as Assistant Teacher (Arts) in Lt. Nahar Singh Inter College, Qwarsi, Aligarh, who is stated to have died in harness on 16.5.2017. An application for grant of compassionate appointment has been made by the petitioner, who claims to be the daughter of the deceased. Grievance of the petitioner is that though petitioner is qualified for grant of appointment on the post of Assistant Teacher or on a Class-III post, but such claim has not been examined so far.
Learned Standing Counsel points out that claim for compassionate appointment has also been made by respondent no.5.
In the event, more than one claim has been put forth for grant of compassionate appointment, the District Inspector of Schools, Aligarh, would be expected to afford an opportunity of hearing to both the claimants and pass appropriate orders, as may be warranted in accordance with the regulations. Attention of the Court has been invited to a letter of the District Inspector of Schools, Aligarh, dated 12.4.2018, whereby notices were issued to the petitioner as also the respondent no.5, fixing 24th April, 2018 as the date for hearing. Grievance is that although sufficient time is lapsed even thereafter, but a decision is still awaited.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to petitioner's claim and to pass an appropriate order in respect of grant of compassionate appointment, after affording an opportunity of hearing to the petitioner as also the respondent no.5, within a period of three months from the date of presentation of certified copy of this order.
