This Second Appeal has been filed against the judgment and decree of the Principal District Judge's Court at Dharmapuri, dated 25.09.2014 in A.S.No.14 of 2012 partly reversing the judgment and decree of the Additional Subordinate Judge's Court at Dharmapuri dated 18.04.2012 in O.S.No.131 of 2008.
2. This second appeal was referred to Mediation to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, by the order of this Court, dated 26.10.2016.
3. A Communication dated 03.03.2017 of the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, enclosing a copy of its Mediation Report, dated 27.02.2017, has been received, and in the said Mediation Report, it is stated as follows:- Both the parties have appeared before the Centre along with their counsels. Matter has been settled between them as per the terms cited in Mediation Agreement, which is enclosed. Hence, the matter is submitted back to the Hon'ble Court.
4. As the parties have arrived at a settlement in terms of the Mediation Agreement, dated 27.02.2017, this second appeal is listed for passing orders in terms of the said Mediation Agreement.
5. Today, both the parties are present before this Court along with their respective counsel on record.
6.The Mediation Agreement, dated 27.02.2017 has been signed by the parties and their respective counsel.
7. In terms of the settlement arrived at between the parties before the Tamil Nadu Mediation and Conciliation Centre, High Court Madras and recording the terms of the Mediation Agreement, dated 27.02.2017, the Second Appeal is disposed of. The Mediation Agreement, dated 27.02.2017 and the Mediation Report, dated 27.02.2017 shall form part of the Judgment. No costs. Consequently, connected Miscellaneous Petition is closed.
