Heard the learned advocate for the applicants and the learned A.P.P for the State.
3. Following aspects are considered :-
(i) Charge sheet has been filed on 22.4.2010;
(ii) Co.accused Valji Rudabhai Karena has been admitted to bail by this Court in Criminal Misc. Application No. 3591/2010 by order dated 23.4.2010;
(iii) Accusation is of offences punishable under Sections 379, 114 IPC and Sections 4, 4(1)A & 21(1) of the Mines and Minerals Act, 1957;
4. Considering the above aspects, the application deserves to be allowed and the same is allowed. The applicants are ordered to be released on bail in connection with Crime Register No. II. 12/2010 of Madhavpur Police Station, on their executing a bond of Rs. 10,000/- (Rupees Ten Thousand only) each with one surety of the like amount to the satisfaction of the lower Court, subject to such conditions which the lower Court may deem fit to impose.
5. Rule is made absolute.
6. Direct Service is permitted.
