This application u/s 482 CrPC has been filed for quashing the order dated 20.2.2016, issuing non-bailable warrant to the applicants in Case No. 285/IX of 2019 (State vs. Raja Ram and others), arising out of Case Crime No. 62 of 2012, u/s 452, 323, 504 IPC, P.S. Kotwali Dehat, district Banda.
Counsel for the applicants submits that the applicants were granted bail by orders dated 18.12.2013 and 17.8.2015, but due to unavoidable circumstances, they could not appear before the court below on 20.2.2016, as such, non-bailable warrants were issued against them.
In the facts of the case, this application is disposed of giving liberty to the applicants to apply for bail before the court below through counsel.
For a period of one month from today, order dated 20.2.2016, issuing non-bailable warrants against the applicants, passed in Case No. 285/IX of 2019 (State vs. Raja Ram and others), arising out of Case Crime No. 62 of 2012, u/s 452, 323, 504 IPC, P.S. Kotwali Dehat, district Banda, shall be kept in abeyance.
