Heard Ms. Ruhi Yadav, learned counsel for the petitioners.
The petitioners are seeking a direction to the Court of District Judge, Aligarh to decide the Civil Appeal No.63 of 2012 [Rajpal Singh (since deceased) and Others Vs. Mukhtyar Singh (since deceased) and Others] expeditiously.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with a direction to the Court of District Judge, Aligarh to decide the Civil Appeal No.63 of 2012 [Rajpal Singh (since deceased) and Others Vs. Mukhtyar Singh (since deceased) and Others] according to his own roster keeping in mind the oldest cases.
It is made clear that the Court has not adjudicated the claim of the petitioners on merit.
