Heard Shri Harish Pratap Singh, learned counsel for the petitioner and Shri Hare Ram Tripathi, learned Standing Counsel for the respondents.
The petitioner is seeking a direction to the respondents to pay him gratuity with interest.
The petitioner is stated to have retired from service on 09.05.2011 in the Hindalco Industries Limited, Renu Sagar Power Division, District Sonbhadra Counsel for the petitioner has not been able to state as to how the Hindalco Industries Limited falls within the definition of 'State'. Hindalco Industries Limited is a private industry and does not have any attribute of State.
For reasons aforesaid, the writ petition is not maintainable in the High Court and is accordingly dismissed as such.
