|

JUDGMENT / ORDER

Court No. - 47
Case :- CRIMINAL MISC. WRIT PETITION No. - 24127 of 2019 Petitioner :- Raj Narayan And 4 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Amit Kumar Singh Counsel for Respondent :- G.A.
Hon'ble Manoj Misra,J. Hon'ble Virendra Kumar Srivastava,J.
Heard learned counsel for the petitioners; learned AGA for respondents 1 and 2; and perused the record.
The instant petition seeks a direction upon the respondents to transfer the investigation of Case Crime No.355 of 2019 to some other investigating agency.
It appears that the petitioners are accused in Case Crime No.355 of 2019 and the matter is pending investigation. It seems that they are aggrieved by repeated notices issued by the Investigating Officers requiring their presence.
According to the learned counsel for the petitioners, the petitioners have been granted anticipatory bail by this Court vide order dated 27th September, 2019 passed in criminal misc. bail application no.38372 of 2019.
Since there is no stay operating against the investigation of the case, the investigation would have to be brought to its logical conclusion. In case, the Investigating Officer is unnecessarily harassing the petitioners, then the petitioners have right to move an application ventilating their grievances before the Senior Superintendent of Police of the district concerned.
With the aforesaid liberty, the petition stands disposed off.
