The petitioner has prayed for the following relief:
"A writ order or direction in the nature of mandamus directing the respondent No. 4 to decide the Election Petition No. T2021121303334 filed by the petitioner on 27.05.2021, (Smt. Raj Kumar versus Asha Devi & 6 others)."'
There is no good cause for this Court to prioritize the hearing of an election petition filed in the year 2021 over other matters pending before the election tribunal.
Faced with this, Sri Rajesh Kumar Yadav, learned counsel for the petitioner seeks leave to approach the election tribunal.
It is open to the petitioner to move an application for expediting the hearing of the election petition before the election tribunal. In case such application is moved, the same shall be decided by the election tribunal in accordance with law and as per its roster.
The writ petition is disposed of. Sri Sashawat Gupta, learned counsel holding brief of Sri Tarun Agarwal, learned counsel for the State Election Commission is present.
