The petitioner claims to have filed an application before the executing court with the prayer for return/auction of articles which according to him were lying in disputed property, at the time of delivery of possession thereof to him. It has been registered as Misc. Case No.1/74/2017.
A perusal of the order sheet reveals that both the parties are duly contesting the case and dates are being fixed by the executing court.
Accordingly, the instant petition is disposed of directing the court below to decide the proceedings, expeditiously, by fixing short dates and without granting unnecessary adjournments.
