This petition has been filed for a direction upon the respondent no. 4 to consider the claim of petitioner for appointment on the post of Assistant Teacher in Scheduled Caste category. Petitioner submits that he is eligible for the post and having applied, his claim is liable to be considered against the vacant post, existing in the department.
While entertaining this petition, learned counsel representing respondent no. 4 was allowed time to obtain instructions. Learned counsel for the respondent submits that the petitioner has secured 56.82 marks while last cut off marks, for Scheduled Caste category candidate is 66.84. It is stated that three posts of Scheduled Caste are still vacant and the same is to be filled by the candidate belonging to Scheduled Caste category.
Learned Standing Counsel submits that the claim of the petitioner would be examined by the authority concerned, on merits, in accordance with law. Considering the above, this petition stands disposed of with a direction upon the respondent no. 4 to accord consideration to the petitioner's claim strictly in accordance with merits of the candidates belonging to Scheduled Caste category. The required consideration shall be made within a period of two months from the date of presentation of certified copy of this order.
