Heard learned counsel for the petitioners, learned Standing Counsel for the State-respondents and Shri Siddharth Singhal, learned counsel for the respondent no. 3.
Learned counsel for the petitioners has confined his argument to the following effect:-
He argues that a process of selection for appointment was carried out by the respondent authorities and candidates who had qualified in the written examination were called in the ratio of 1:3 candidates. He further argues that at the time of interview, substantial number of applicants were found to be ineligible and out of the 72 posts to be filled, the tentative candidates who fulfilled the eligibility criteria was less than 72. He thus requests that the respondents be directed to reduce the cut off marks and all the candidates in the ratio of 1:3 should be called. He further argues that in the event, such an exercise is not directed, the petitioners may become overage and may not be able to get the employment for all times to come.
The petitioners, except petitioner no. 4, before this Court are the persons who could not reached the cut off list as prepared by the respondent authorities and thus want that if the cut off list is reduced, they would get a chance to participate and be considered for selection.
No irregularity or illegality has been pointed out with regard to the conduct of respondents in fixing the cut off limits, once the petitioners have not qualified the cut off list, no right vests in the petitioners to contend that cut off list by the respondents should be reduced.
That being the case, no case for interference is made out. The writ petition lacks merits and is dismissed. It is, however, provided that the respondents will take action in accordance with the advertisement and in accordance with law.
