Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P and perused the material available on record.
By way of the instant application, the applicant seeks bail in Case Crime No. 371 of 2018, under Sections - 420, 406 I.P.C., Police Station - Kotwali Orai, District - Jalaun.
Contention raised before this Court is that the informant of this case happens to be an agent of a company named Bright India Wallet Recharge Company. He has got no concern with the offence in question. The applicant has not committed any offence. He too happens to be merely an agent of the company concerned and has not, in any way, benefited himself from the transaction of the company.
Per contra, learned A.G.A. has submitted that in this case, the applicant happens to be the Managing Director of the company in question. He was in control of shares of the company. He misappropriated the public money by embezzling Rs.6 lakhs of the investors and thereafter he refused to pay back the amount in question.
Considered the rival submissions and perused the material brought on record. No good ground is made out for bail.
Accordingly, the instant bail application is rejected, at this stage.
It is made clear that the observation made in this order shall not be construed to have any reflection on merit of the case.
