Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed with a prayer to direct the Judicial Magistrate, Mau to decide the application filed under Section 245 Cr.P.C. in Case No. 1177 of 2015 (Abhilasha Pandey Vs. Rahul Pandey and other), arising out of Complaint Case No. 1327 of 2012, under Sections 498A, 323, 504, 506 IPC & Section 3/4 Dowry Prohibition Act, Police Station Cantt., District Gorakhpur within stipulated period.
Learned counsel for the applicants submits that applicant no.1 has already expired during pendency of this application on 24.04.2020, as such, on his behalf present, application is not pressed.
Learned counsel for the applicants submits that application under Section 245 Cr.P.C., filed by applicant nos. 2 and 3, father-in-law and mother-in-law of the opposite party no.2, is pending since 20.10.2016 and since then, proceeding has been lingering-on, on one pretext or the other.
In view of the above, learned court below is directed to make all endeavours to decide the aforesaid application as expeditiously as possible, preferably within a period of three months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid application.
With the aforesaid direction, this application under Section 482 Cr.P.C. is finally disposed of.
