Heard learned counsel for the petitioner.
In view of the order proposed to be passed, notices need not go to the respondent.
The petitioner has preferred the present petition under Article 227 of the Constitution of India with the prayer to issue a direction to the Principal Judge, Family Court, Agra to decide the Marriage Petition No.989 of 2019 (Rahul Vs. Nimisha) under Section 13 of the Hindu Marriage Act expeditiously. Learned counsel for the petitioner argued that the matter is pending since long and large number of dates were fixed in the matter but till date no final decision has been taken on the same. He further argued that due to pednency of the aforesaid suit, the petitioner is suffer from irreparable loss and prays for expeditious disposal.
Heard learned counsel for the petitioner and perused the record.
In the facts and circumstances of the case, without entering into merits of the case, the present petition is disposed of finally with a direction to the court below to consider and decide the matter on its turn without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
