Heard learned counsel for the petitioner, Sri Manoj Kumar Yadav for the Gaon Sabha and the learned Standing Counsel.
Learned Standing Counsel appearing for the Assistant Collector states that subject to verification of all facts including whether the orders under Section 122-B have attained finality and that no appeals are pending against the same, all further action shall be taken to ensure that the encroachments are removed in accordance with the orders passed by the Assistant Collector. It is further stated that the proceedings shall be taken forward with expedition and with due notice to the respondent No.5.
The statement so made is recorded and accepted. The petition shall stand disposed of on the above terms.
