Heard learned counsel for the applicants and the learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed with the prayer to quash the order dated 3.10.2019 passed by Sessions Judge, Hathras passed on the applications 7-kha and 8 kha in criminal revision no. 135 of 2019 relating to case no. 656 /12/2019 (new no. 1998 of 2019), case crime no. 280 of 2016, under Sections 498-A, 304-B, 201 IPC and further to stay further proceedings of the aforesaid case against the applicants and to direct the Court concerned to decide the aforesaid revision expeditiously.
It appears that vide order dated 3.10.2019 applications moved by applicants in the aforesaid criminal revision pending before the Sessions Judge concerned for summoning the lower court record for disposal of criminal revision were rejected with the observation that revision could be decided on the basis of papers submitted by the revisionists. If the observations recorded by the trial court in the impugned order are taken into consideration, in my view, there is no infirmity or illegality in the said order. Revisionists could file certified copy of the documents available on record on which they placed reliance. The application being devoid of merits is liable to be dismissed and the same is accordingly dismissed.
