Short counter affidavit has been filed on behalf of respondent no. 4, which is taken on record.
Heard Sri Ram Prakash Dwivedi, learned counsel for the petitioners, Sri Rakesh Kumar Tiwari, learned counsel for the respondent no.4, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 27.7.2018 registered as case crime no.0820 of 2018 under sections 364 I.P.C., police station New Agra, District Agra.
Learned counsel for the petitioners submits that the respondent no. 4 who is victim of the case is working at Gurgaon and is a major girl aged about 21 years and she has herself filed an affidavit before the SSP concerned denying the participation of the petitioners in the present case and her I.D. is on record at page 29.
Learned A.G.A. opposed the prayer for quashing.
Sri Rakesh Kumar Tiwari has filed short counter affidavit on her behalf and has stated that she has no grudge against the petitioner.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but they shall co- operate with the investigation of the case.
With the above direction this petition is finally disposed of.
