Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief:-
"a) A writ, order or direction in the nature of Mandamus directing the respondent no. 1/Assistant Collector, First Class/Sub-Divisional Officer, Sadar, District Saharanpur to decide Case No. RA/204-15 "Somma and Ors. Vs. State of U.P. and Another", within stipulated time period or if possible within three moths as may be fixed by this Hon'ble Court."
The petitioner is aggrieved as he claims to be an 'Asami' of land recorded as 'Johad' having been granted a lease for growing 'Singhada'. It is stated that the possession over the land leased out to the petitioner has not been provided on account of pendency of the suit aforesaid, which is one under Section 229- B of the U.P.Z.A. & L.R. Act and has been filed by the respondent no. 2 to 4. It is submitted that the suit is pending consequent to an order of remand passed in the year 2014.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 1 i.e. Assistant Collector, First Class/Sub-Divisional Officer, Sadar, District Saharanpur to decide the suit as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before him.
