JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through jail seeking temporary bail for a period of 45 days so as to get agricultural land partitioned amongst brothers.
Rule.
Learned APP, Mr.Pujari, waives service of rule on behalf of respondent-State.
Learned APP has invited attention of the Court to the application of the convict; wherein, he mentioned that his four children are residing with his mother, who is aged and his wife has already expired. His eldest son is 16 years old and he is maintaining the family with petty labour work. His mother is having less vision. It is further stated in the application that his brother who is cultivating agricultural land is not giving any produce to the children or the mother. Therefore, he wants to undertake partitioned of the agricultural work.
The application is supported by Village Form No.VII and XII and Form No.VIII-A.
For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of 45 days from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
