Heard learned counsel for the applicant, Sri Vikas Sahai, the learned A.G.A. for the State and perused the record.
The instant application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicant in Case Crime No. 433 of 2019, under Sections 420, 342, 328, 323, 506 IPC, police station Gajraula, District Amroha/J.P. Nagar.
Learned A.G.A. appearing for the State on instructions points out that a proclamation under Section 82 Cr.P.C. has already been issued against the applicant. In view thereof and bearing in mind the decision of the Supreme Court in Lavesh v. State (NCT of Delhi) [(2012) 8 SCC 730], the Court finds itself unable to entertain this application, which shall stand rejected.
