Heard learned counsel for the petitioner and learned Standing Counsel. Shri B.P. Singh appears for third and fourth respondent.
The petitioner is before this Court for a direction to the respondents to pay the arrears of salary of promotional post of Head Mistress in Junior High School from 6.7.2015 to 31.3.2016 and consequential retiral benefits including arrears of retiral dues.
Learned counsel for the petitioner submits that the controversy in hand is squarely covered by the judgment and order dated 26.7.2017 passed in Special Appeal Defective No.382 of 2017 (Kailash Yadav & Ors. v. Mr. Nand Lal Ram & Ors.) and similar indulgence may also be accorded to the petitioner.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of with observation that in case the petitioner moves a fresh representation to the fourth respondent i.e. District Basic Education Officer, Azamgarh within ten days, the same shall be considered and decided in accordance with law within two months thereafter.
