Challenge in this writ petition is to an auction notice dated 07.02.2018 for grant of a fisheries lease of a pond situated in Village Balliyan, Pargana Sadar, District Shahjahanpur being plot no. 303 area 0.78 hectares.
The case of the petitioner is that in 2010, a lease of this plot had been granted in favour of one Sukhdeebh, who executed a sub lease in favour of the petitioner.
It also appears to be his case that on the basis of auction notice, the respondent no. 4, who was the highest bidder in the auction held on 07.02.2018 is interfering in his possession.
There is no provision for the lessee of a pond to execute a sub lease.
Under the circumstances, the petitioner has no locus to maintain this writ petition.
For the same reason, this writ petition fails and is dismissed.
Even otherwise, the auction notice has already worked itself out as the auction was duly held on 07.02.2018 and the highest bid was that of respondent no. 4, which bid amount was actually deposited by him, the same day.
