Heard learned counsel for the petitioners, learned Standing Counsel and Sri S.K. Singh learned counsel for the Gaon Sabha.
Learned counsel for the petitioners has filed the instant writ petition with a prayer that the proceedings under Section 67 of the U.P. Revenue Code, 2006, be quashed.
Today, the notice which had initiated the proceedings has been filed by means of the supplementary affidavit. The contention of the learned counsel for the petitioners is that even though in the notice the allegation made is that the constructions were being made on plot no. 212, in fact, they were made over the plot no. 209.
In this regard, the petitioners may file a reply to the notice and if an application alongwith the reply is filed to locate the plot, then a proper demarcation would be done and, thereafter, the Tehsildar shall proceed with the proceedings.
With these observations, the writ petition is disposed of.
