The fair price shop licence of the petitioner was cancelled by order dated 19.3.2018. The petitioner carried the order of termination in appeal. The appeal was registered as Appeal No. 000371/2018, Computer Case No. C-201817000000371 (Radhey Shyam Vs. District Supply Officer, Siddharth Nagar) before the learned Commissioner, Basti Division, Basti. The memo of appeal was accompanied by an application for interim relief. The appeal was instituted on 6.4.2018. The appeal came up for hearing on various dates namely 6.4.2018, 12.4.2018 and 18.4.2018.
The only prayer made by Sri Ashutosh Pandey, learned counsel for the petitioner is that the stay application accompanying with the memo of appeal may be decided within stipulated period of time. He contends that the purpose of filing the stay application shall be defeated in case, the same remains pending indefinitely.
Learned Standing Counsel has no serious objection to the aforesaid prayer.
In view of the submissions made at the Bar, the respondent no. 1 or any other authority, before whom the stay application is pending, shall decide the same within 15 days from the date of receipt of certified copy of this order.
With the aforesaid observations/directions, this writ petition is disposed of.
