Heard Sri Anurag Shukla, learned counsel for the appellants, learned A.G.A. for the State and perused the record.
This Criminal appeal has been filed against the order dated 21.11.1984 and 01.12.1984 passed by Special Judge Etawah in Misc. Case No.58 of 1984 whereby appellant has been convicted and sentenced to six months civil imprisonment.
Learned counsel for the appellant submitted that both the appellants were sureties of the accused-Gulab and appeal stood dismissed as abated against the appellant No.1. It has next submitted that on 21.11.1984, he was in jail so he could not produced the accused in the Court. It was further submitted that accused Gulab Singh was also in jail on 22.08.1984. Learned trial court has not found plausible explanation give by the sureties and appellant No.2 was sent to jail. It has further submitted that appellant No.2 is ready to submit amount of Rs.2000/- ordered by the court below.
Without going into merit of the case, this appeal is being disposed of directing the appellant No.2 to deposit the amount of Rs.2000/- as sureties bond within 45 days.
With these directions this appeal is finally disposed of.
