JUDGMENT / ORDER

The review petitioner claims to be an attaching creditor. The attachment was effected on 13.07.2006 in respect of a loan advanced on 08.08.2005. But the mortgage in favour of the second respondent is anterior (29.03.2005).
2. The review petitioner challenges the sale conducted under the SARFAESI Act. The review petitioner can as well invoke Section 17 of the SARFAESI Act for that purpose. The review petitioner laments that the borrower was not made a party to the writ petition. But then the borrower has not applied for review.
There is no error apparent on the face of the record. The review petition is dismissed.
