Heard Sri Bijay Kumar Srivastava, learned counsel for the appellant.
This appeal is filed against the order dated 08.08.2018 passed by the 5th Additional District Judge, Mirzapur in Civil Appeal No.13 of 2015 by which the learned Judge has remanded the matter to the court below to decide the issue after considering the merit of the case and after considering the evidence adduced by the respective parties.
In my view, there is no error apparent on the face of the order impugned nor the same is pointed out by the learned counsel for the appellant.
However, it is provided that the court below will proceed in the matter and after providing due opportunity to the respective parties will decide the matter expeditiously, within a period of six months from the date of production of certified copy of this order or from today, which ever is earlier.
The appeal is disposed of.
