Road Tumkur – 572 101. …Respondents (By Sri B Balakrishna, AGA) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to issue directions to the respondents to investigate suicide of Sunith.R.Mahara Noor dtd. 11.03.2019 as per Annx-‘C’ due to torture by Niketha, Naveen, Keerthana and to take action by way of writ of mandamus.
This Writ Petition coming on for Preliminary Hearing this day, the Court made the following:-
ORDER Sri. Jagadeesh Achari, learned counsel for the petitioner.
Sri. B. Balakrishna, learned AGA for the respondents.
2. The petition is admitted for hearing. With the consent of learned counsel for the parties, the same is heard finally.
3. In this petition, the petitioner inter alia seeks a direction to respondents to investigate the case of suicide of son of the petitioner.
4. When the matter was taken up today, learned Counsel for the petitioner submitted that the petitioner had filed a complaint to the Superintendent of Police with a copy to the Police Sub-Inspector, Hosabadavane Police Station, Tumakuru. It is further submitted that the complaint discloses the commission of cognizable offences. However, no FIR was registered.
5. Learned AGA submitted that suitable action, in accordance with law, on the complaint will be taken.
6. In view of the aforesaid submissions and in the facts of the case, the writ petition is disposed of with a direction to respondents to take an action on the complaint submitted by the petitioner contained in Annexure-F in accordance with the law laid down by the Hon’ble Supreme Court in case of LALITA KUMARI VS. GOVERNMENT OF UTTAR PRADESH AND ORS.’, (2014) 2 SCC 1. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the writ petition is disposed of.
