Heard learned counsel for the petitioner and the learned Standing counsel.
The petitioner alleges that he had a temporary construction of a shed over plot no. 4216 old no. 7953, situate in village -Sherpur, Post Jamaniaya, Tehsil Mohammadabad, District Ghazipur. The said shed had fallen and he wants to re-erect it but the Tehsildar and other revenue officers visited the site and stopped the petitioner from re-erecting the shed. The petitioner accordingly moved application for permission to the District Magistrate for the purposes of re-erecting the shed.
It is also revealed from the pleadings that in respect of the above plot the petitioner has filed Writ C No. 12136 of 2019 wherein an interim order has been passed staying the orders of the District Magistrate.
In view of the above, it is apparent that the petitioner is having some private dispute regarding the said land and the State authorities have no role to intervene in the said private dispute.
Learned counsel for the petitioner has failed to show us any provision under which permission is required for re-erecting the shed from any authority.
In view of the above, the writ petition is disposed of with the direction to the respondents not to interfere in any private dispute of land as is also directed vide G.O. dated 1.12.2014.
