1.0. Present Civil Application under Section 5 of the Limitation Act has been preferred by the applicants herein original respondents to condone the delay 206 days in preferring the Civil Revision Application against the proceedings arising out of the Mamlatdar Courts Act.
2.0. Having heard Shri Sidharth Dave, learned advocate for the contesting respondents and Shri Kabir Hathi, learned AGP appearing on behalf of respondent nos. 1 and 7 and considering the averments in the application in support of prayer to condone the delay and so as to allow the applicant to submit the case on merits rather than non suiting them on technical ground of delay, delay caused in preferring the Civil Revision Application is hereby condoned. Rule is made absolute to the aforesaid extent. No costs. Registry is directed to notify the main Civil Revision Application for admission hearing on 15th March 2012.
