JUDGMENT / ORDER

1.0. Leave to amend para 2 of the application by substituting names of the present trustees as per the particulars furnished by the learned advocate for the respondent.
2.0. Rule.
Shri Vyas, learned advocate waives service of notice of Rule on behalf of present trustees whose names have been mentioned in para 2 of the present application and who are sought to be joined as party respondent in the main Second Appeal. In the facts and circumstance of the case and with the consent of the learned advocates for the respective parties, the application is taken up for final hearing today.
3.0. Having heard Shri Antani, learned advocate for Shri Chhaya, learned advocate for the applicants and Shri Vyas, learned advocate appearing on behalf of present trustees whose names have mentioned in para 2 of the present application and as the application is not opposed, the present application is allowed and the applicants are permitted to join persons mentioned in para 2 of the present application (as per amended para 2) as respondent nos. 1 to 5 as trustees of Dholka Khoda Dhor Panjarapole in place of respondent nos. 1 to 8 mentioned in the cause title of the Second Appeal. Rule is made absolute to the aforesaid extent. Registry is directed to amend the cause title of the main Second Appeal accordingly.
