The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the order dated 15.12.2017 passed in Public Interest Litigation No. 59818 of 2017 (Rita Singh Vs. State of U.P. and 3 Others). The order is reproduced hereinbelow :-
"None appears for the parties.
The grievance of the petitioner is that respondents 3 and 4 have encroached upon public road of Gali No. 3, situated at Gurunanak Nagar, Naini, Allahabad, as a result of which, the residents of the locality and other persons are facing inconvenience.
Having regard to this grievance, it is open to the petitioner to invoke the provisions of Section 133 of the Code of Criminal Procedure, 1973. We, accordingly, leave it open to the petitioner to move an appropriate application before the competent authority for an expeditious decision thereon.
The petition is, accordingly, disposed of."
Today when the matter is taken up, Shri K. R. Singh, learned Additional Chief Standing Counsel appearing on behalf of opposite party has placed before this Court an affidavit of compliance, the same is taken on record. It is stated that the order passed by the writ court has already been complied with. Though the order passed by the writ court has already been complied with, therefore, no cause of action remained survive.
In view of the same, the present contempt application is dismissed.
