For Petitioner : Mr.B.Jawahar For Respondent : Mr.C.Emalias, APP ORDER This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate, Rasipuram to dispose of the case in CC No.320 of 2014 within a time frame to be fixed by this Court.
2. It is the case of the petitioner that he has been implicated as accused in Crime No.185 of 2014 by the respondent police. After due investigation, charge sheet was filed for the offences punishable under Sections 279 and 304(A) IPC and the same was taken on file as CC No.320 of 2014 by the learned Judicial Magistrate, Rasipuram. Thereafter, trial has commenced, however, the same is yet to be completed. Hence, this Criminal Original Petition.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who took notice for the respondent.
4. Considering the facts and circumstances of the case and also taking note of the fact that the case is pending from the year 2014, this Court directs the learned Judicial Magistrate, Rasipuram, to expedite the trial of the case in CC No.320 of 2014 pending on his file, on day today basis and dispose of the same, on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order. This Criminal Original Petition is disposed of accordingly.
