Against the order impugned, admittedly, the petitioner has an alternative remedy of filing an appeal before respondent no.1.
Counsel for the petitioner submits that as the petitioner was prosecuting this petition, its appeal may not be entertained by the appellate authority holding it to be barred by limitation. He submits that in the eventuality of filing any such appeal, the appellate authority be directed to decide the same ignoring the point of limitation.
State Counsel has no objection to this proposition.
Petition is dismissed as withdrawn with the aforesaid liberty. Needless to state that in the eventuality of filing any such appeal by the petitioner, the appellate authority may decide the same in accordance with law, ignoring the point of limitation.
