Heard Sri Rohit Pandey, learned counsel holding brief of Sri Pratik Chandra, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The petitioner Institution has filed the instant petition seeking a mandamus commanding the respondents to sanction and release fee reimbursement and scholarship of SC/ST students of the Institution, who were admitted on zero fee basis and whose scholarship amount has not been reimbursed so far. The case of the petitioner is that for Academic Session 2017-18, the amount has not been reimbursed in respect of seven students.
Sri Rohit Pandey, learned counsel holding brief of Sri Pratik Chandra, learned counsel for the petitioner has also relied on judgments passed by this Court in similar facts in Writ-C No. 38912 of 2018, Panchwati Institute of Engineering and Technology vs. State of U.P. and Others.
Learned Standing Counsel submitted that respondent no. 2 is competent to examine the grievance of the petitioner.
Accordingly, the instant petition is disposed of with liberty to the petitioner to make a fresh representation before respondent no. 2 along with certified copy of this order. The said representation shall be decided by the respondent no. 2 by a reasoned and speaking order expeditiously, preferably within a period of three months from the date of receipt of a certified copy of this order along with the representation.
The Court has not gone into the veracity of the assertions in the writ petition nor has the claim of the petitioner been judged on merits. It is onerous responsibility of the State authorities to diligently enquire into the matter and verify the claims of the petitioner after independent application of mind.
